Liability Waiver and Assumption of Risk

1. Who must review and accept this waiver

Each adult participant must review this waiver before participating and may be asked to sign an additional paper or electronic form. The primary booker must share the waiver, tour requirements, and safety information with every member of the group.

A parent or legal guardian must review and accept the applicable risk information for a minor and must decide whether the activity is appropriate for that child. Acceptance by one customer does not replace a signature from another adult participant when a separate signature is requested.

2. General travel and outdoor risks

Belize tours can involve vehicles, boats, water taxis, local flights, caves, rivers, ocean conditions, trails, stairs, archaeological structures, wildlife areas, farms, stables, forests, heat, humidity, rain, insects, and remote locations. These environments contain inherent and changing risks that cannot be completely removed even when reasonable safety measures are used.

Possible risks include slips, falls, cuts, bruises, sprains, fractures, heat illness, dehydration, allergic reaction, panic, motion sickness, equipment discomfort or failure, vehicle or boat incidents, water-related injury, animal behavior, falling objects, delayed emergency response, illness, serious injury, disability, and death.

3. Activity-specific risks

Caves, ATM Cave, and cave tubing

Cave activities may involve darkness, confined spaces, uneven and slippery rock, river crossings, swimming or floating, climbing, low ceilings, sharp surfaces, falling rock, changing water levels, and limited access to immediate medical assistance. ATM Cave and other active cave experiences can require sustained walking, water entry, balance, and the ability to follow strict archaeological and safety rules.

Snorkeling, swimming, boats, and marine activities

Marine and water activities may involve currents, waves, depth, reduced visibility, coral, marine life, boat movement, ladders, wet decks, seasickness, weather, and distance from shore. A life jacket or flotation device reduces but does not eliminate risk. Guests must honestly disclose swimming ability and must remain within guide instructions.

Ziplining and heights

Ziplining may involve heights, harnesses, cables, platforms, ladders, braking systems, impact, suspension, and equipment fit. Weight, age, health, clothing, footwear, and operator restrictions may apply. Guests must use all equipment exactly as directed.

Horseback riding

Horses are live animals whose behavior can be unpredictable. Risks include mounting or dismounting falls, kicks, bites, sudden movement, uneven terrain, branches, weather, saddle movement, and interaction with other animals or riders.

Mayan sites, trails, and wildlife areas

Archaeological and nature sites may include steep or uneven steps, unguarded edges, loose stone, tree roots, mud, insects, wildlife, heat, and long walking distances. Wildlife sightings are never guaranteed, and guests must not approach, feed, touch, or disturb animals unless an authorized guide expressly permits it.

Road and other transportation

Transportation may involve public roads, traffic, road damage, weather, remote routes, boats, water taxis, and independent carriers. Seat belts and other restraints must be used when available and required. Delays and emergency access may differ from the guest’s home country.

4. Health, fitness, and truthful disclosure

Each participant is responsible for deciding whether they are medically and physically able to participate. Before booking or as soon as known, guests should disclose information reasonably relevant to safety, including:

• pregnancy or possible pregnancy;
• heart, blood-pressure, breathing, seizure, balance, or circulation conditions;
• recent surgery, serious illness, or back, neck, knee, or joint injury;
• serious allergies, medication needs, or risk of severe reaction;
• mobility limitations or need for assistance;
• fear of heights, water, darkness, wildlife, or enclosed spaces;
• limited swimming ability or inability to swim; and
• any condition that may affect use of safety equipment or response in an emergency.

Disclosure does not guarantee that participation will be approved. It allows Private Belize Adventure and the activity provider to consider reasonable adjustments or recommend a different experience. Guests should seek medical advice from a qualified professional when uncertain about fitness for an activity.

5. Guide instructions and safety equipment

Participants must follow instructions from guides, drivers, captains, park staff, and activity operators. Required helmets, life jackets, harnesses, tubes, lights, footwear, seat belts, or other equipment must be worn and used as directed.

A participant may be refused or removed without refund for intoxication, unsafe behavior, harassment, unauthorized separation from the group, refusal to use required equipment, interference with wildlife or cultural property, or failure to follow a safety instruction. A participant must immediately report damaged, poorly fitting, or uncomfortable safety equipment before continuing.

6. Weather, wildlife, and changing conditions

Belize is a tropical destination. Rain, lightning, heat, flooding, river level, ocean condition, visibility, road access, wildlife behavior, insects, and site rules may change with little notice. The guide or operator may change, delay, shorten, substitute, or stop an activity when reasonably necessary for safety.

Guests accept that wildlife sightings and natural conditions cannot be guaranteed. Disappointment with weather, visibility, water conditions, or wildlife does not by itself mean the service was unsafe or not delivered.

7. Independent suppliers and additional waivers

Some services are operated by independent parks, reserves, transport providers, boat operators, stables, ziplines, cave operators, restaurants, or guides. Those suppliers may have separate rules, eligibility requirements, insurance, and waivers. Guests agree to review and follow those requirements.

Private Belize Adventure remains responsible for its own obligations but does not control every independent supplier, public road, attraction, border authority, carrier, or natural condition.

8. Emergency assistance and medical costs

If a participant cannot communicate during an emergency, the participant authorizes reasonable first aid and assistance in contacting local emergency or medical services. Private Belize Adventure cannot guarantee the availability, response time, capability, or cost of an emergency provider.

The participant remains responsible for personal medical treatment, medication, ambulance, boat or road transport, air evacuation, hospital, repatriation, accommodation, and related expenses except to the extent another person is legally responsible. This is one reason personal medical and evacuation insurance is strongly recommended.

9. Personal property

Participants are responsible for passports, phones, cameras, cash, medication, bags, jewelry, and other belongings. Water, humidity, rain, caves, vehicles, boats, and outdoor activity may damage or cause loss of property. Bring only suitable items and use waterproof or protective storage where appropriate.

10. Informed assumption of risk and limited release

By booking, electronically accepting, signing, or voluntarily participating after receiving this information, each participant acknowledges the nature of the selected activities and accepts the inherent risks that remain after reasonable precautions.

To the fullest extent permitted by applicable law, the participant agrees not to hold Private Belize Adventure, its owners, employees, guides, drivers, contractors, or agents liable for loss caused solely by an inherent risk voluntarily accepted by the participant, the participant’s own act or omission, refusal to follow instructions, failure to disclose relevant information, or an event outside reasonable control.

This limited release does not apply to fraud, willful misconduct, gross negligence, or any liability or remedy that Belize law or another applicable mandatory law does not permit the parties to exclude or limit.

11. Travel insurance acknowledgment

Every traveler is strongly encouraged to obtain personal travel medical, evacuation, cancellation, interruption, and activity-appropriate insurance. Business or supplier insurance does not replace a traveler’s personal coverage. Review the Travel Insurance Advisory before departure.

12. Electronic acceptance and policy record

The booking checkout requires the primary booker to acknowledge this waiver and the related booking policies. Private Belize Adventure may retain the booking details, policy version, and acceptance date with the reservation record. An activity provider may still require every adult participant, or a parent or guardian for a minor, to complete a separate waiver before participation.
